Terms and Conditions:
This Agreement does not constitute an insurance contract. This Appliance and Air Conditioner Service Contract ("the Agreement") is a legal contract that describes the terms and conditions of the Agreement you purchased. Keep this document with your purchase receipt as proof of ownership. There are no deductibles for services covered by this Agreement.
"Retailer" is the entity that sold the Agreement to You, as indicated on the Specifications Page.
“Fee” means the fee You paid to have coverage under this Agreement, as set forth on the Specifications Page.
“Purchase Price” refers to the price You paid to the Retailer for the Covered Product, as indicated on the Specifications Page.
“Covered Product” means the product for which this Agreement was purchased and is listed on the Specifications Page.
“You”, “Your” and “Yours” indicate the holder of this Agreement.
“We”, “Us” and “Our” indicate the provider Assurant Services of Puerto Rico, Inc., Torre Chardón, 350 Carlos Chardón Ave., Suite 1101, San Juan, PR 00918.
We will repair your Covered Product or deliver a similar replacement item if we are unable to complete a covered repair due to unavailability of working parts or technical information, without applying any deductibles for the service(s). Replacement items will include delivery and basic installation.
WHAT IS COVERED - REPAIR: The repair service provided under this Agreement shall consist of the labor and parts necessary to restore the Covered Product to its normal operating condition. Repair of the Covered Product shall not exceed the retail purchase price of the original Covered Product.
DELAYS IN REPAIR: We will not be liable for any damages arising from delays and in no event will we be liable for consequential damages. If Your repair takes more than 45 days to complete, the expiration date of Your Agreement will be extended by the amount of time it takes to complete the entire repair, except when parts are unavailable, in which case We will proceed in accordance with the section “NON-AVAILABILITY OF PARTS IN CASE OF REPAIR.”
NON-AVAILABILITY OF PARTS IN CASE OF REPAIR: If replacement parts needed for the repair cannot be obtained within 45 days, we will proceed as provided in the settlement option in the "REPLACEMENT OPTION" section of this Agreement. Neither we nor the Retailer will be liable for any damages resulting from the unavailability of replacement parts.
TYPES OF SERVICE AND SERVICE LOCATIONS IN CASE OF A REPAIR: In case you have purchased:

In-Home Service , as indicated on Your purchase receipt or the Specifications Page, repairs will be performed at Your residence. An adult (with legal capacity to act) must be present at the location where service will be performed in Your Home. If You live beyond a thirty-five (35) mile radius of an authorized service center, You may be required to return the Covered Product to the authorized service center.

Service at an Authorized Service Center (“Carry-In”) As indicated on your purchase receipt or the Specifications Page, repairs will be performed at an authorized service center. You are responsible for delivering your covered product to the repair center for repairs and for picking up the product after the repair work is completed.
REPLACEMENT OPTION: At Our option, We may replace Your Covered Product with a new or reconditioned product of like kind and quality if We are unable to repair Your Covered Product, or when the cost of repair would exceed the actual retail replacement value of Your Covered Product. The price of the replacement product will not exceed the retail Purchase Price of the original Covered Product. If We elect to replace Your Covered Product, and a replacement product, as described above, is unavailable, We will pay You a settlement. The settlement amount will be the lesser of:

the current Retail Purchase Price of a replacement product of the same type and quality, or
-
the retail Purchase Price you paid for the original Covered Product.
Replacement of a Covered Product or payment of a settlement will fully satisfy this Agreement and cancel any additional obligations under this Agreement, to the extent permitted by law. Once the product is replaced, this Agreement will be terminated and consumed. If you wish to protect the replaced product, you must purchase a new Service Contract.
If we replace your covered product, the original product will become our property. If you purchased In-Home Service or Carry-In Service and your covered product was replaced, you may be required to return the original product to an authorized service center.
TECHNOLOGICAL ADVANCES AND THE AVAILABILITY OF REPLACEMENT PRODUCTS MAY CAUSE A REPLACEMENT PRODUCT TO COST LESS THAN THE ORIGINAL PRODUCT (THE NON-REPAIRABLE COVERED PRODUCT). IN ANY CASE, THE COMPARABILITY OF A REPLACEMENT PRODUCT WILL BE DETERMINED BY US IN OUR SOLE DISCRETION. ZERO DEFECTIVE EQUIPMENT POLICY: If Your Covered Product breaks down three (3) times due to the failure of the same part(s) during the term of the Agreement, after the expiration of the manufacturer's warranty period, We will proceed as provided in the “REPLACEMENT OPTION” section. Such replacement or settlement will constitute compliance with this Agreement and will cancel any other obligations under this Agreement, to the extent permitted by law. Once the product is replaced, this Agreement will be terminated and consumed.
WHAT IS NOT COVERED FOR MINI SPLITS AIR CONDITIONERS.
- Inadequate facilities;
- Installations that have not been carried out by an authorized refrigeration technician;
- Installations with more than fifteen feet (15') of distance between its components;
- Power supply other than that recommended by the manufacturer;
- Drainage water liques;
- Damage or malfunction of other electrical appliances, electronic equipment, or any device or home that depends on the product for its operation;
- Removal and reinstallation in a location other than where it was originally installed;
- External electrical connections;
- Breaker box;
- Brakers; • Electrical connection cables;
- Skirt covers;
- Anchors or supports;
- External drainage water pumps;
- Pipe insulators;
- Remote control or its batteries;
- Breakdowns or malfunctions caused by lack of maintenance;
- Any other external device or accessory added to the product
IF YOU NEED SERVICE : Call the phone number on the Specifications Page. We will select an authorized repair center that will contact you to arrange for service. You must contact us if the performance of your repair is not satisfactory.
SERVICE AVAILABILITY: Service in Your Home or at an Authorized Repair Center (“Carry-In”) will be available Monday through Friday from 9:00 am to 5:00 pm and Saturday from 9:00 am to 12:00 pm, local time, during regular business hours and during the repair center’s work week.
PARTS: Materials provided as replacement parts will be drawn from Our service contractor's inventory of new or rebuilt parts and components.
EFFECT(S) OF THE MANUFACTURER'S WARRANTY ON COVERAGE. Covered Products requiring parts and service that are still within the manufacturer's warranty or recall period will be serviced by the Authorized Repair Facility in accordance with the manufacturer's guidelines. IF THE TERM OF THIS AGREEMENT OVERLAPSES THE TERM OF YOUR MANUFACTURER'S WARRANTY, PLEASE SEEK COVERAGE UNDER YOUR MANUFACTURER'S WARRANTY FIRST. THIS AGREEMENT DOES NOT INCLUDE COVERAGE FOR ANY LOSSES COVERED BY YOUR MANUFACTURER'S WARRANTY, BUT MAY STILL PROVIDE BENEFITS IN ADDITION TO THOSE PROVIDED BY YOUR MANUFACTURER'S WARRANTY . This Agreement provides benefits in addition to those provided by your manufacturer's warranty until the term selected by You under this Agreement.
WHAT IS NOT COVERED: Furniture and associated non-operational (“cosmetic”) components of Your Product, such as protective glass, filters, the antenna, consumer-replaceable batteries, styluses, trays, shelves, light bulbs, consumer-replaceable projector bulbs, ribbons, sleeves or hoses, knobs or handles, bags, pre-installed, custom-designed, or proprietary software, remote controls, software applications installed after Your original purchase of a computer product, or the installation of any of the foregoing items. This Agreement does not cover any product recall programs, whether or not the manufacturer is still in business. This Agreement does not cover products used for commercial or institutional purposes, previously used products, or products without an original manufacturer’s warranty. This Agreement does not cover operational failure of the product caused by voltage fluctuations.
SERVICES THAT ARE NOT COVERED UNDER THIS AGREEMENT:
- Maintenance, repair, or replacement service required for any loss or damage resulting from any cause other than normal use according to the manufacturer's specifications, such as, but not limited to, loss or damage due to abuse, unauthorized repair, improper installation, mold, corrosion, insect infestation, fire, water, hurricane, hail, earthquake, theft, neglect, riot, lightning, flood, malicious damage, vandalism, civil commotion, arson, or explosion.
- It does not cover services or repairs to products due to damage caused by animals.
- In no event shall it be liable for any special, indirect, incidental, or consequential damages, regardless of whether arising under contract, tort, or negligence.
- It does not cover service interruption, delay, or loss of functionality related in any way to, for example, any entertainment services such as subscriptions or programming.
- Custom-designed or proprietary programs from third parties, applications that were installed after your original purchase of a computer product, or program errors that confirm that the programs are not functioning properly or are defective.
- .Loss or corruption of data, damage resulting from computer viruses, and/or the restoration of programs and operating systems to Your Covered Product.
- Radio frequency interference resulting from improper installation or proximity to other electronic equipment.
- Claims arising from any breach of any express or implied warranty of merchantability or fitness of the product on the part of the manufacturer.
- Installation, reprogramming, or initial connection of Your product is not covered, such as: electronic equipment installed on walls (Wall mount), that is using additional cables and/or accessories.
- Removal and reinstallation are not covered under this Agreement, except as determined by Us. This applies to fixtures and equipment with complex or custom-made installations that must be removed to provide service. (Example: cabinets, furniture, gypsum board, etc.)
- Repair or replacement caused by defects that existed prior to the purchase of this Agreement.
WHAT YOU MUST DO: Non-technical cleaning to provide a normal operating environment, as described in the manufacturer's instruction manual for the Covered Product, is Your responsibility. You must provide normal household cleaning for your Covered Product.
RENEWALS : This Agreement is not renewable.
TRANSFERS: This Agreement is not transferable
CANCELLATION AND REFUND:

You may cancel this Agreement at any time and for any reason by sending a cancellation request by mail to 350 Carlos Chardón Ave. Suite 1101, Torre Chardón, San Juan, PR 00918 or by calling us toll-free at 787-250-1199 Monday through Friday from 9:00 am to 5:00 pm and Saturday from 9:00 am to 12:00 pm.

If You cancel this Agreement within the first thirty (30) days of delivery of the Service Contract, and the Fee has been paid, and no claim has been paid, You will receive a full refund equal to the Agreement Fee. In the event this Agreement is canceled after the first thirty (30) days of delivery of the Service Contract, or within the first thirty (30) days and You have filed a claim, We will refund You the unearned amount of the Agreement Fee. We will pay a 10% penalty per month on any refund that has not been paid or credited within thirty (30) days.

If you cancel the Agreement for any reason, including non-payment, this will constitute cancellation of the Service Agreement by you, subject to the terms and conditions described in this Agreement.

We may cancel this Agreement for any reason during the first sixty (60) days by sending you written notice with the date of cancellation and the reason for cancellation, to your last known mailing address, at least fifteen (15) days prior to cancellation. After sixty (60) days, we may only cancel this Agreement by:

non-payment;

fraud or material misrepresentation; or
-
substantial breach of obligations on your part.
- If we terminate this Agreement for the reasons stated above, we will send you written notice with the date of termination and the reason for termination, to your last known mailing address, at least fifteen (15) days prior to termination. We will refund the Fee to you as provided in section b. of this Section.
REPEATED SERVICE: If Your Covered Product requires service more than once within a 60-day period, it must be completed by the original repair center.
START DATE OF THIS AGREEMENT: Coverage begins on the Manufacturer's Warranty Expiration Date. This Agreement expires on the date indicated on the Specifications Page or as stated under "Total Years of Coverage."
SPECIAL PROVISION: The obligations of Assurant Services of Puerto Rico, Inc. under this Agreement are secured by a reimbursement insurance policy. If Assurant Services of Puerto Rico, Inc. fails to pay or provide a claimed service within sixty (60) days of notification of the claim, you will have the right to file a claim directly with the insurer issuing the policy, Caribbean American Property Insurance Company, at the following address: Torre Chardón, #350 Ave. Carlos Chardón, Suite 1101 San Juan, PR 00918, or you may call the toll-free number 1-800-981-8888.
